1. Our Relationship & Platform Role
YourWayCareLink provides a specialized digital marketplace connecting Clients (individuals and families) with Support Workers.

Sub-Contractor Status: All Support Workers are engaged as Independent Sub-Contractors, not employees. Workers are responsible for their own income tax, ACC, and GST obligations.

The 17% Service Fee: YourWayCareLink retains a 17% service fee from each booking. This fee covers platform maintenance, client marketing, administrative support, professional advocacy from our legal and nursing team, and Public Liability Insurance for active bookings.

No-Bypass Clause: To protect the integrity of the platform and the insurance coverage provided, all bookings and payments between a Client and a Worker introduced via YourWayCareLink must be processed through the platform. Attempting to bypass the platform for private payment may result in immediate termination of account access.
2. Client & Worker Empowerment

Hourly Rates: Support Workers have the autonomy to set their own hourly rates and create their own professional profiles.

Finding Work: Workers are responsible for securing their own clients through the platform, though YourWayCareLink will provide suggestions and support to facilitate matches.

Cancellation Policy: Each worker must select and display a cancellation policy of either 12 hours or 24 hours notice. Clients who cancel within this window may be charged the full booking fee.
3. Professional Advocacy & Funding

Our Background: Our leadership team includes professionals with Nursing, Law, and Business backgrounds. We provide advocacy for both clients and workers to ensure high standards of care and fair treatment.

Government Funding: We provide administrative support for clients navigating funding through Te Whatu Ora and other agencies. However, we cannot guarantee funding outcomes as these are determined by government bodies. Clients remain liable for fees until funding is confirmed.
4. Insurance & Liability

Liability Insurance: YourWayCareLink provides Public Liability Insurance for care services performed during an active, platform-recorded booking.

Vehicle & Transport Disclaimer: This platform insurance does not cover motor vehicle accidents. Support Workers are strictly required to maintain their own Comprehensive Vehicle Insurance that covers the transport of clients as part of their sub-contracting duties. YourWayCareLink is not liable for any incidents occurring during vehicle transport.
5. Conduct, Safety & Rights

Harassment: We maintain a zero-tolerance policy for harassment, misconduct, or discrimination. Any breach will result in immediate removal from the platform.

HDC Code of Rights: All parties must uphold the Code of Health and Disability Services Consumers' Rights. We prioritize the dignity, independence, and choice of the individual receiving care.

Reporting & Investigations: In the event of a clinical concern or complaint, our nursing and legal team may facilitate a review. We reserve the right to share relevant vetting information with regulatory bodies (such as the HDC) if a formal safety investigation is launched.

Continuity of Care: YourWayCareLink will provide reasonable assistance in organizing "cover" staff and facilitating necessary training for workers to meet specific client needs.
